Y&R Lucy going to unfit parent to another unfit parent?

Okay so my question is why did the judge take Lucy away from Billy and Victoria to give her to someone who was also declared as an unfit parent??? That confused me. Daniel should try and get his rights reinstated and just take Lucy and run off. Why didn't Raffe state that after the judge awarded Phyllis temporary custody. You take Lucy because Billy and Vikki are declared unfit parents only to give her to another unfit mother???
